(1) ഈ ആക്റ്റിൽ സ്പഷ്ടമായി മറ്റു പ്രകാരം വ്യവസ്ഥ ചെയ്തിട്ടുള്ളതോ, ഈ ആക്റ്റിൻ കീഴിൽ നിർണ്ണയിക്കാവുന്നതോ ആയതൊഴികെ, ഈ ആക്റ്റോ അതുപ്രകാരമുണ്ടാക്കിയ ഏതെങ്കിലും ചട്ടമോ ബൈലായോ പ്രകാരം, ഏതെങ്കിലും ലൈസൻസിനോ, അനുവാദത്തിനോ, അല്ലെങ്കിൽ അതു പുതുക്കുന്നതിനോ ഉള്ള ഏതൊരു അപേക്ഷയും, ലൈസൻസോ അനുവാദമോ ആവശ്യമുള്ള ഏറ്റവും ആദ്യത്തെ തീയതി മുതൽ അല്ലെങ്കിൽ ലൈസൻസോ അനുവാദമോ ആവശ്യമുള്ള കാലം അപേക്ഷയിൽ പറഞ്ഞിട്ടുള്ള മൂന്ന് വർഷമോ അതിൽ കുറഞ്ഞ കാലമോ തുടങ്ങുന്നതു മുതൽ മുപ്പതു ദിവസത്തിൽ കുറയാതെയും തൊണ്ണൂറു ദിവസത്തിൽ കവിയാതെയും ഉള്ള സമയത്തിനുള്ളിൽ കൊടുത്തിരിക്കേണ്ടതാകുന്നു.

(2) ഈ ആക്റ്റിൽ സ്പഷ്ടമായി മറ്റു പ്രകാരം വ്യവസ്ഥ ചെയ്തിട്ടുള്ളതോ ഈ ആക്റ്റിൻ കീഴിൽ നിർണ്ണയിക്കാവുന്നതോ ആയതൊഴികെ, അപ്രകാരമുള്ള ഏതൊരു ലൈസൻസിനും അല്ലെങ്കിൽ അനുവാദത്തിനും, ഏത് വ്യാപാരത്തിന് ലൈസൻസോ അനുവാദമോ കൊടുക്കുന്നുവോ ആ വ്യാപാരം സംബന്ധിച്ചുള്ള സേവനം അനുഷ്ഠിക്കുന്നതിനും ആ വ്യാപാരത്തിന്റെ നിയന്ത്രണത്തിനും വേണ്ടി വരുന്ന ചെലവ് യഥാവിധി പരിഗണിച്ചുകൊണ്ട് ഗ്രാമപഞ്ചായത്ത് നിശ്ചയിക്കാവുന്ന യൂണിറ്റുകളിലും നിരക്കുകൾ അനുസരിച്ചും ഫീസ് ചുമാത്താവുന്നതാകുന്നു.

(3) മേൽപ്പറഞ്ഞ പ്രകാരമൊഴികെ, അപ്രകാരമുള്ള ഏതെങ്കിലും ലൈസൻസിനോ അനുവാദത്തിനോ വേണ്ടിയുള്ള ഒരപേക്ഷയിൻമേൽ, ആ അപേക്ഷ സെക്രട്ടറിക്ക് ലഭിച്ചതിനുശേഷം, മുപ്പത് ദിവസത്തിനകമോ, ഏതെങ്കിലും വിഭാഗം സംഗതികൾ സംബന്ധിച്ച് നിർണ്ണയിക്കാവുന്ന കൂടുതൽ കാലത്തിനുള്ളിലോ, ഉത്തരവ് അപേക്ഷകനെ അറിയിക്കാതിരുന്നാൽ, ആ അപേക്ഷ സാധാരണയായി അനുവദിക്കുമായിരുന്ന കാലം വല്ലതുമുണ്ടെങ്കിൽ അക്കാലത്തേക്ക് സാധാരണയായി വിധേയമാക്കപ്പെടുമായിരുന്ന നിയമത്തിനും ചട്ടങ്ങൾക്കും ബൈലായ്ക്കും എല്ലാ നിബന്ധനകൾക്കും വിധേയമായും അനുവദിക്കപ്പെട്ടിരുന്നതായി കരുതേണ്ടതാണ്.

(4) അപ്രകാരമുള്ള ഏതെങ്കിലും ലൈസൻസിനോ അനുവാദത്തിനോ വേണ്ടിയുള്ള ഫീസ് മുൻകൂറായി അടയ്ക്കുന്നത് സ്വീകരിക്കുന്നതായാൽ, അത് അപ്രകാരം പണം മുൻകൂറായി അടയ്ക്കുന്ന ആൾക്ക് ആ ലൈസൻസോ അനുവാദമോ കിട്ടാൻ യാതൊരവകാശവും നൽകാത്തതും എന്നാൽ ലൈസൻസോ അനുവാദമോ നിഷേധിക്കുന്ന പക്ഷം ഫീസ് തിരിയെ കിട്ടുന്നതിനുമാത്രം അവകാശം നൽകുന്നതുമാകുന്നു.

(5) അപ്രകാരമുള്ള ഏതെങ്കിലും ലൈസൻസോ, അനുവാദമോ ആവശ്യമുള്ള ഒരു പ്രവൃത്തി,ആ ലൈസൻസോ അനുവാദമോ കൂടാതെയോ കിട്ടിയിട്ടുള്ള ലൈസൻസിലെയോ അനുവാദത്തിലെയോ വ്യവസ്ഥകൾക്ക് വിരുദ്ധമായ രീതിയിലോ ചെയ്തിട്ടുള്ള പക്ഷം,-

(എ.) സെക്രട്ടറിക്ക് നോട്ടീസുമൂലം, അപ്രകാരമുള്ള പ്രവൃത്തി ചെയ്യുന്ന ആളോട്, നോട്ടീ സിൽ പറയേണ്ടുന്ന കാലത്തിനകം, അത് ബാധിക്കുന്ന ജംഗമോ, സ്ഥാവരമോ, പൊതുവകയോ, സ്വകാര്യവകയോ ആയ ഏതെങ്കിലും വസ്തു മുഴുവനായോ, ഭാഗികമായോ മാറ്റുകയോ നീക്കം ചെയ്യുകയോ, അല്ലെങ്കിൽ കഴിയുന്നിടത്തോളം അതിനെ അതിന്റെ പൂർവ്വസ്ഥിതിയിലാക്കുകയോ ചെയ്യാൻ ആവശ്യപ്പെടാവുന്നതും ഗ്രാമപഞ്ചായത്ത് നിർദ്ദേശിക്കുന്നതായാൽ അപ്രകാരം ആവശ്യപ്പെടേണ്ടതും, കൂടാതെ

(ബി) അപ്രകാരമുള്ള പ്രവൃത്തി ചെയ്യുന്നതിന് ഈ ആക്റ്റിൽ പ്രത്യേകമായി യാതൊരു ശിക്ഷയ്ക്കും വ്യവസ്ഥ ചെയ്തിട്ടില്ലെങ്കിൽ, അപ്രകാരം ചെയ്യുന്ന ആളെ, അപ്രകാരമുള്ള ആയിരം രൂപയിൽ കവിയാതെ പിഴ നൽകുകയും ആവർത്തന കുറ്റത്തിന് പിഴയുടെ റേറ്റ് വർദ്ധിപ്പിക്കാവുന്നതും മൂന്ന് കുറ്റത്തിന് ശേഷം പഞ്ചായത്തിന് യുക്തമെന്ന് തോന്നുന്ന കടുത്ത പിഴശിക്ഷ നൽകുകയോ പ്രോസികൃഷൻ നടപടികൾ സ്വീകരിക്കുകയോ ചെയ്യാവുന്നതാണ്.

(6) അപ്രകാരമുള്ള ഏതെങ്കിലും ലൈസൻസോ അനുവാദമോ വാങ്ങാതിരിക്കുന്നത് സംബന്ധിച്ച ഒരു കുറ്റത്തിന് എപ്പോഴെങ്കിലും ആരുടെയെങ്കിലും മേൽകുറ്റം സ്ഥാപിച്ചിരുന്നാൽ, മജിസ്ട്രേട്ട്, ചുമത്താവുന്ന ഏതെങ്കിലും പിഴയ്ക്കും പുറമെ, ലൈസൻസിനോ അനുവാദത്തിനോ ചുമത്തേണ്ട ഫീസ് തുക സമ്മറിയായി വസൂലാക്കി ഗ്രാമ പഞ്ചായത്തിന് കൊടുക്കേണ്ടതും, അദ്ദേഹത്തിന് യുക്തംപോലെ, ശിക്ഷാനടപടികളുടെ ചെലവായി താൻ നിശ്ചയിക്കാവുന്ന തുക വല്ലതുമുണ്ടെങ്കിൽ അതും സമ്മറിയായി ഈടാക്കി ഗ്രാമപഞ്ചായത്തിന് നൽകാവുന്നതുമാകുന്നു.

വിശദീകരണം.-ഈ ഉപവകുപ്പുപ്രകാരം ലൈസൻസിനോ അനുവാദത്തിനോ വേണ്ടിയുള്ള ഫീസ് വസൂലാക്കുന്നതായാൽ അത് കുറ്റസ്ഥാപനം ചെയ്യപ്പെട്ട ആൾക്ക് ലൈസൻസോ അനുവാദമോ കിട്ടാൻ യാതൊരവകാശവും നൽകുന്നതല്ല.

(7) ലൈസൻസോ അനുവാദമോ നൽകുകയോ നിരസിക്കുകയോ ചെയ്തുകൊണ്ട് സെക്രട്ടറി പാസ്സാക്കുന്ന ഏതൊരുത്തരവും ഗ്രാമപഞ്ചായത്തിലെ നോട്ടീസ് ബോർഡിൽ പ്രസിദ്ധപ്പെടുത്തേണ്ടതാണ്.

(8) ലൈസൻസോ അനുവാദമോ നിരസിക്കുകയോ, നിറുത്തിവയ്ക്കുകയോ, റദ്ദാക്കുകയോ ഭേദഗതി ചെയ്യുകയോ ചെയ്തുകൊണ്ട് സെക്രട്ടറി പാസ്സാക്കുന്ന ഏതൊരുത്തരവും, രേഖാമൂലമായിരിക്കേണ്ടതും, ഏത് കാരണങ്ങളിൻമേൽ നടപടി തുടരുന്നുവോ ആ കാരണങ്ങൾ കാണിക്കേണ്ടതുമാകുന്നു.

(9) ഈ ആക്റ്റോ അതിൻകീഴിൽ ഉണ്ടാക്കിയ ഏതെങ്കിലും ചട്ടമോ പ്രകാരം നൽകിയിട്ടുള്ള ഏതെങ്കിലും ലൈസൻസിലെയും അല്ലെങ്കിൽ അനുവാദത്തിലെയും നിബന്ധനകളിലോ പരിമിതികളിലോ ഉപാധികളിലോ ഏതിലെങ്കിലും നിന്ന് അത് വാങ്ങിയ ആൾ ഒഴിഞ്ഞുമാറുകയോ, അവയിൽ ഏതെങ്കിലും ലംഘിക്കുകയോ ആ ലൈസൻസോ അനുവാദമോ സംബന്ധിച്ച് ഏതെങ്കിലും കാര്യത്തിൽ, അത് വാങ്ങിയ ആൾ, ഈ ആക്റ്റിലെ വ്യവസ്ഥകളോ, അതുപ്രകാരം ഉണ്ടാക്കിയിട്ടുള്ള ഏതെങ്കിലും ചട്ടങ്ങളോ ലംഘിച്ചതിന് കുറ്റസ്ഥാപനം ചെയ്യപ്പെട്ടിരിക്കുകയോ അല്ലെങ്കിൽ അത് കിട്ടിയ ആൾ, തെറ്റിദ്ധരിപ്പിച്ചോ, ചതിച്ചോ അത് വാങ്ങിച്ചിരിക്കുകയോ ചെയ്താൽ സെക്രട്ടറിക്ക് അപ്രകാരമുള്ള ലൈസൻസോ അനുവാദമോ ഏതവസരത്തിലും നിറുത്തിവയ്ക്കുകയോ, പിൻവലിക്കുകയോ ചെയ്യാവുന്നതാണ്.

(10) ഏത് സ്ഥലങ്ങളുടെ കാര്യത്തിൽ ഈ ആക്റ്റ് മൂലമോ ആക്റ്റിൻകീഴിലെ ലൈസൻസോ അനുവാദമോ ആവശ്യമുണ്ടോ ആ സ്ഥലങ്ങൾ പരിശോധിക്കുന്നത് സെക്രട്ടറിയുടെ കർത്തവ്യമായിരിക്കുന്നതും, അദ്ദേഹത്തിന് അപ്രകാരമുള്ള ഏതൊരു സ്ഥലത്തും ഉദയാസ്തമയ വേളകൾക്കിടയിൽ പ്രവേശിക്കാവുന്നതും, ഈ ആക്റ്റ് മൂലമോ അതിനു കീഴിലോ ലൈസൻസോ അനുവാദമോ ആവശ്യമുള്ളിടത്ത് അതു കൂടാതെയോ അല്ലെങ്കിൽ അതിന് അനുയോജ്യമല്ലാതെ മറ്റു വിധത്തിലോ ഏതെങ്കിലും സ്ഥലത്ത് എന്തെങ്കിലും ചെയ്തതുകൊണ്ടിരിക്കുന്നുവെന്ന് വിശ്വസിക്കാൻ അദ്ദേഹത്തിന് കാരണമുണ്ടെങ്കിൽ, ഏതെങ്കിലും നിയമ വ്യവസ്ഥയോ, ഏതെങ്കിലും ചട്ടങ്ങളോ, ലൈസൻസിലെയോ അനുവാദത്തിലെയോ ഏതെങ്കിലും നിബന്ധനയോ നിയമാനുസൃതമായ ഏതെങ്കിലും നിർദ്ദേശമോ നിരോധനമോ ലംഘിക്കുന്നുണ്ടോ എന്ന് സ്വയം ബോദ്ധ്യപ്പെടുന്നതിനായി ആ സ്ഥലത്ത് നോട്ടീസ് കൂടാതെ പകലോ രാത്രിയോ ഏതവസരത്തിലും അദ്ദേഹത്തിന് പ്രവേശിക്കാവുന്നതും, സെക്രട്ടറിയോ അദ്ദേഹം നിയമാനുസൃതം തന്റെ അധികാരങ്ങൾ ഏൽപ്പിച്ചു കൊടുത്തിട്ടുള്ള ഏതെങ്കിലും ആളോ ഈ ഉപവകുപ്പിൻ കീഴിൽ അധികാരങ്ങൾ വിനിയോഗിക്കുന്നതു മൂലമോ, ഈ ഉപവകുപ്പു പ്രകാരം പ്രവേശനം നടത്തുമ്പോൾ ആവശ്യമായി വരുന്ന ഏതെങ്കിലും ബലപ്രയോഗം മൂലമോ അനിവാര്യമായും നേരിടുന്ന ഏതെങ്കിലും നഷ്ടത്തിനോ, അസൗകര്യത്തിനോ യാതൊരാൾക്കെതിരായും യാതൊരവകാശവാദവും പുറപ്പെടുവിക്കാൻ പാടില്ലാത്തതുമാകുന്നു.

(11) ഏതെങ്കിലും ലൈസൻസോ അനുവാദമോ നിറുത്തിവച്ചിരിക്കുകയോ പിൻവലിച്ചിരിക്കുകയോ ചെയ്യുമ്പോഴോ, ഏത് കാലത്തേക്ക് അത് നൽകപ്പെട്ടുവോ അല്ലെങ്കിൽ ഏതു കാലത്തിനുള്ളിൽ പുതുക്കാനുള്ള അപേക്ഷ കൊടുക്കേണ്ടിയിരിക്കുന്നുവോ, ഇതിലേതാണോ ഒടുവിൽ അവസാനിക്കുന്നത് ആ കാലം കഴിഞ്ഞുപോകുമ്പോഴോ, ഈ ആക്റ്റിന്റെയോ അതിൻകീഴിൽ ഉണ്ടാക്കിയിട്ടുള്ള ഏതെങ്കിലും ചട്ടത്തിന്റെയോ എല്ലാ കാര്യങ്ങൾക്കും, അതു വാങ്ങിയ ആൾ അതതു സംഗതിപോലെ ലൈസൻസോ അനുവാദമോ റദ്ദാക്കുകയോ പിൻവലിക്കുകയോ ചെയ്തുകൊണ്ടുള്ള ഉത്തരവ് റദ്ദാക്കപ്പെടുന്നതുവരെയോ, (3)-ഉം (4)-ഉം ഉപവകുപ്പുകൾക്ക് വിധേയമായി ലൈസൻസോ അനുവാദമോ പുതുക്കുന്നതുവരെയോ ആ ലൈസൻസോ അനുവാദമോ കൈവശം ഇല്ലാത്ത ആളാണെന്ന് കരുതപ്പെടുന്നതാണ്.

(12) ലൈസൻസോ അനുവാദമോ വാങ്ങിയ ഏതൊരാളും, ആ ലൈസൻസോ അനുവാദമോ പ്രാബല്യത്തിലിരിക്കുമ്പോൾ, ന്യായമായ എല്ലാ സന്ദർഭങ്ങളിലും സെക്രട്ടറി ആവശ്യപ്പെടുമ്പോൾ അത് ഹാജരാക്കേണ്ടതാണ്.

(13)ഈ വകുപ്പിലെ വ്യവസ്ഥകളിൽ എന്തുതന്നെ അടങ്ങിയിരുന്നാലും, ഗ്രാമപഞ്ചായത്തിന് നൽകേണ്ടതായ ഏതെങ്കിലും നികുതിയോ ഫീസോ മറ്റു കടങ്ങളോ നല്കാനുള്ള ഏതൊരാൾക്കും ഈ ആക്റ്റിൻ കീഴിലുള്ള ഏതൊരു ലൈസൻസോ അനുവാദമോ നൽകാൻ പാടുള്ളതല്ല.
